Consent And Release For Use Of Photographs and Images

Please read the information below carefully and thoroughly before booking. Your completed
and legally signed DocuSign documents are required before your booking can be confirmed.
At this time, we do not offer alternative methods. Wild Women Hawai'i will contact you within
24 hours after your completed registration to confirm your eligibility and participation in the
event. Failure to complete the forms may result in a refund according to the refund policy.
By booking, you agree to be bound by these Terms and Conditions that govern the
relationship, the cancellation policy, and limitations of liability. These Terms and Conditions
affect your rights and designate the governing law and forum for the resolution of any and all
disputes. Please read them carefully as you will be bound by them. These Terms shall
constitute the entire agreement between Wild Women Hawai'i LLC ("Wild Women Hawai'i") and
the participant relating to the subject matter herein and shall constitute a binding agreement.
 

Cancellation Policy
* 80% refund of the total for cancellation 60+ days before the event start date.
* 50% refund of the total for cancellation 45-59 days before the event start date.
* 0% refund for cancellation 0-44 days before the event start date.

You are entitled to a full refund if the event is postponed and not rescheduled within 90 days of
the postponement.

You are entitled to a full refund if the event is canceled and not rescheduled by Wild Women
Hawai’i within 90 days of the cancellation.

There are no exceptions to the Cancellation Policy. CFAR (Cancel For Any Reason) trip
insurance is highly recommended in case you have to cancel due to unforeseen
circumstances.

By attending this event, I agree to the following:
1. I understand violations of the terms and conditions of this agreement may result in
immediate excusal from the event without a refund.
2. I understand this event is intended as a safe space for adult women.
3. I understand guests and pets will not be allowed into the event area at any time.
4. I understand this is a rain-or-shine event.
5. I understand this event is free from alcohol, drugs, vaping, and smoking.
6. I understand this event is free from all weapons.
7. I understand bullying is not allowed and that we all have the responsibility to create a
welcoming environment.
8. I understand this is a closed retreat and that I am asked to put aside the time to
experience the whole retreat, from welcome to closing, without leaving or coming
and going. Not only is this beneficial for me, but it also maintains a safe, nurturing
space for everyone throughout the retreat.
9. I agree to maintain the confidentiality of all information shared by all attendees
during the event. The information shared may be sensitive and proprietary, and I
agree not to disclose it to anyone without written permission from Wild Women
Hawai’i.
10. I understand that the tools, processes, strategies, materials and information
presented in the Retreat are confidential, copyrighted, and proprietary to Wild
Women Hawai’i, and agree not to record, duplicate, distribute, teach, or train from
the Retreat materials in any manner whatsoever without the express written
permission of Wild Women Hawai’i. Any unauthorized use or distribution of these
proprietary concepts, materials, and intellectual property by you or your
representatives is prohibited and we will pursue legal action and full damages if
these terms are violated to protect its rights.
11. I understand photography and the recording of any persons other than myself
involved in the event are not allowed. Wild Women Hawai’i may take photos or
arrange for a trusted photographer, and I am welcome to share images that Wild
Women Hawai'i shares in public.
12. I am encouraged to disconnect from my phone as much as possible and give
myself an electronics retreat.
13. I will leave my phone on silent or shut down throughout the event.
14. I understand that I am encouraged to leave work behind during the event. If I must
tend to work in any way, I will do so privately.
15. To maintain a peaceful atmosphere, I understand that religious and political
indoctrination and debate are unwelcome at all Wild Women Hawai’i events.
16. I understand that women-empowered worldly rituals, ceremonies, and songs may
be included at this retreat.
17. I understand this event is a network-free environment.
18. I will not market or distribute my products in any way in the event space.
19. I will not request or accept money for my products or services in the event space at
any time.
20. I understand food at this event will be processed in a kitchen that produces dishes
with milk, wheat, soybean, tree nuts, peanuts, eggs, and egg products.
21. I understand my dietary restrictions must be communicated on the registration form
or caterer’s questionnaire when booking. Because of the preparation needed, last-
minute requests cannot be accommodated.
22. I understand the schedule is subject to change without notice.
23. I understand this event includes outdoor physical activities. I am trusted to know
my limits and plan accordingly.
24. I agree to abide by all rules and safety guidelines required by the venue and
location where this event will take place.
25. I understand activities cannot be guaranteed if conditions are deemed unsafe.
26. I am voluntarily participating in all activities entirely at my own risk.
27. I am responsible for my own medical insurance and medical bills in an emergency.
28. I understand that 911 may called against my will if deemed necessary and I will be
fully responsible for any charges or liabilities.
29. I agree to contact Wild Women Hawai’i with full disclosure before booking if I have
medical or other conditions that might affect my or others' safety and enjoyment of
the event.
30. I understand this retreat cannot replace or substitute for the services of trained
professionals in any field, including, but not limited to, mental, financial, medical,
psychological, or legal fields. We do not offer any professional personal, medical,
financial, or legal advice and none of the information contained in the Retreat should
be confused as such advice.
31. If my health changes between the time of booking and the event, I will notify Wild
Women Hawai’i of these changes before the day of the event.
32. I agree to be financially and legally responsible for any damage or injury I cause
during the event.
33. As part of Wild Women Hawaii’s commitment to fostering sisterhood, I agree to
attend all sharing circles and ceremonies during the retreat.
34.Depending on the retreat and accommodation, I understand a bed-sharing discount
may be available, but it is not guaranteed. If available, both party's bookings must be
completed on the same day or I will need to repay the discount.
35. I understand discounts cannot be honored or refunded after booking.
36. I understand special requests of any kind do not form part of this agreement, and
therefore, Wild Women Hawai'i is not liable for not providing these requests.
37. Wild Women Hawai’i reserves the right to refuse service.
38. I understand this event is not designed to explore Hawai’i. I am encouraged to rent
a car and/or explore beforehand.
39. Attendee Conduct: Wild Women Hawai’i requires all Attendees to be respectful to
our staff, hosts, and other attendees throughout the Retreat, even during non-
scheduled downtime and breaks. Wild Women Hawai’i reserves the right to ask the
Attendee to leave the Retreat location immediately should they be deemed rude,
uncooperative, or in possession of any illegal substance. In such case, the
Attendee's fees for the Retreat will not be reimbursed under any circumstances and
they will not receive any future services or correspondence from Wild Women
Hawai’i.

Hold Harmless Waiver
In consideration of the risk of injury while participating in Wild Women Hawai'i Events
(the “Activity”), and as consideration for being allowed to participate in the Activity, I
hereby, for myself, my heirs, executors, administrators, assigns, or personal
representatives, knowingly and voluntarily enter into this waiver and release of liability
and hereby waive any and all rights, claims or causes of action of any kind whatsoever
arising out of my participation in the Activity, and do hereby release and forever
discharge Wild Women Hawai’i LLC, affiliates, managers, members, agents, attorneys,
staff, volunteers, heirs, representatives, predecessors, successors, and assigns, for any
physical or psychological injury, including but not limited to illness, paralysis, death,
dismemberment, damages, economical or emotional loss, that I may suffer as a direct
result of my participation in the aforementioned Activity. I am voluntarily participating in
the aforementioned activity and I am participating in the activity entirely at my own risk.
I am aware of the risks associated with traveling to and from as well as participating in
the activity, which may include but are not limited to, physical or psychological injury,
pain, suffering, illness, disfigurement, and temporary or permanent disability. I
understand that these injuries or outcomes may arise from my own or others’
negligence, travel conditions, or the activity location's condition. Nonetheless, I
assume all related risks, both known or unknown to me, of my participation in this
activity, including travel to, from, and during this activity. I agree to indemnify and hold
harmless Wild Women Hawai’i LLC against any and all claims, suits, or actions of any
kind whatsoever for liability, damages, compensation, or otherwise brought by me or
anyone on my behalf, including attorney fees and any related costs. This Agreement
was entered without duress or coercion and is to be interpreted as an agreement
between two parties of equal bargaining strength. Both the Participant and Wild
Women Hawai’i LLC agree that this Agreement is clear and unambiguous as to its
terms, and that no other evidence will be used or admitted to alter or explain the terms
of this Agreement, but that it will be interpreted based on the language in accordance
with the purposes for which it is entered into.

LIABILITY DISCLAIMER: NO PROFESSIONAL ADVICE
I understand this retreat cannot replace or substitute for the services of trained
professionals in any field, including, but not limited to, mental, financial, medical,
psychological, or legal fields. We do not offer any professional personal, medical,
financial, or legal advice and none of the information contained in the Retreat should be
confused as such advice.
Neither Wild Women Hawai’i LLC nor their assigns, sponsors, speakers, partners,
contractors or any of their affiliates will be liable for any direct, indirect, consequential,
special, exemplary or other damages to the Attendee or the Attendee's business,
including economic loss, that may result from participation in the Retreat or from the
use of, or the inability to use, the materials, information, or strategies communicated
through the Retreat or any products or services provided pursuant to the Retreat, even
if advised of the possibility of such damages. Under no circumstances, including but
not limited to negligence, will Wild Women Hawai’i LLC be liable for any special or
consequential damages that result from Attendee's participation in the Retreat.
To be clear: You, the Attendee, alone are responsible and accountable for your
decisions, actions and results in life, and by your participation in our Retreat, you agree
not to attempt to hold us, Wild Women Hawai’i LLC nor our assigns, sponsors,
speakers, partners, contractors or any of their affiliates, liable for any decisions, actions
or results that you make or experience in business or in life due to your participation in
this Retreat at any time, under any circumstance.

INFECTIOUS VIRUSES OR ILLNESS
By participating in this event, I acknowledge the contagious nature of COVID-19 and
other illnesses and voluntarily assume the risk that I may be exposed to or infected by
COVID-19 or other illnesses by attending the activity and that such exposure or
infection may result in personal injury, illness, permanent disability, and death. I
understand that the risk of becoming exposed to or infected by COVID-19 or other
illnesses during this activity may result from the actions, omissions, or negligence of
myself and others, including, but not limited to volunteers and program participants
and their families. I understand and agree that this release includes any Claims based
on the actions, omissions, or negligence of Wild Women Hawai’i LLC whether a
COVID-19 or other infection occurs before, during, or after participation in any Wild
Women Hawai’i event.

CONFIDENTIALITY AND NON-COMPETE
Attendee hereby understands that the tools, processes, strategies, materials, and
information presented in the Retreat are confidential, copyrighted, and proprietary to
Wild Women Hawai'i and agrees not to record, duplicate, distribute, teach, or train from
the Retreat materials in any manner whatsoever without the express written permission
of Wild Women Hawai'i. Any unauthorized use or distribution of these proprietary
concepts, materials, and intellectual property by you or your representatives is
prohibited, and Wild Women Hawai'i will pursue legal action and full damages if these
terms are violated to protect its rights.
I agree to the Hold Harmless Waiver:
Consent And Release For Use Of Photographs and Images
I (the Attendee) hereby give Wild Women Hawai’i and its respective employees, agents,
contractors, and assigns, the irrevocable and perpetual right, consent, and permission
to use, re-use, publish, and re-publish, create digitized images of, adapt, distribute,
transmit, and exhibit any photographs, slides, recordings, electronically created media,
other film images, and/or other likenesses or media, now known or hereafter to
become known, taken of me during my participation in this Wild Women Hawai’i event.
The photographs and/or images may be used in whole, or in part, individually or in
conjunction with other images in any medium and for any purpose, including, but not
limited to illustration, promotion, and advertising of the events and programs, and other
marketing programs related to promoting Wild Women Hawai’i. I hereby release, waive,
and discharge Wild Women Hawai’i from any and all claims, actions, loss, demands, or
liability arising out of, or in connection with, the use of the photographs and/or images
in any of the media described hereinabove.
By participating in the Retreat, I (the Attendee) understand that portions of the Retreat
may be recorded in video and/or captured in still and/or digital photographs. I agree
that Wild Women Hawai’i and its assigns have the right and permission to use such
recordings and photographs should they include the Attendee's name, likeness,
testimonial, or photograph for marketing, advertising, or any other purpose in any
media or format, online and/or offline, now or hereafter without further compensation,
permission, or notification to the Attendee.
Attendee understands and agrees that all recordings from the Wild Women Hawai’i
events are the exclusive rights of Wild Women Hawai’i and Attendee does not ask for
or expect compensation for the use of recordings or photographs in which Attendee
appears. Wild Women Hawai’i owns all rights of any audio, video, and/or photograph
captured during the Retreat or at any other live events.
